These Terms of Service ("Terms") are an agreement between you and Up Your Bids LLC, which operates the Bidographer service ("Bidographer," "we," "us," "our"). By creating an account, buying credits, or using Bidographer, you agree to these Terms. If you do not agree, do not use the service.
Bidographer is software that helps businesses find government contract opportunities and prepare proposals. It reads a solicitation you provide and helps you draft and assemble a response. Bidographer is a tool that assists you; it does not act as your lawyer, your accountant, or your agent, and it does not submit anything to any agency on your behalf. You deliver your own bid.
Bidographer is a private company. It is not a government agency and is not affiliated with, endorsed by, sponsored by, or connected to any federal, state, or local government or any government entity. Government solicitations, forms, and information referenced in the service are public records; our use of them does not imply any government relationship.
Bidographer prepares documents at your direction using automated and AI tools. You are solely responsible for reviewing everything it produces and for deciding what to submit. Automated tools can make mistakes or omit requirements. Before you submit any bid, you must review it for accuracy and completeness and confirm it meets the solicitation's requirements and applicable law. Nothing Bidographer generates is legal, financial, tax, or professional advice.
Government contracting is competitive, and awards are decided by the agencies, not by us. We do not guarantee that you will win any contract, that your bid will be found responsive, or that using Bidographer will produce any particular result. Any statistics or examples we show are illustrative, not a promise of your outcome.
You are responsible for the accuracy of the information you provide and for activity under your account. Keep your sign-in access secure. You must be at least 18 years old and authorized to act for the business you represent. Do not create an account for someone else without their authorization, and do not use an email you do not control.
Some features are free; building a full proposal uses credits. The cost is shown before you spend. Credits are purchased in packs, and payments are processed by Stripe — we do not see or store your full card number. Prices and pack sizes may change; the price shown at the time of purchase applies. Except where required by law, purchased credits are non-refundable, with one exception: if a build fails, the credits it used are returned to your balance automatically. Credits have no cash value and are not transferable.
You keep ownership of the documents and information you upload and of the proposals you create. You grant us a limited license to store and process that content only to provide the service to you. We do not sell your content, and we do not share your bid with other vendors. See our Privacy Policy for details on how we handle your information.
Bidographer, including its software, design, branding, and content we create, belongs to Up Your Bids LLC and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive right to use the service under these Terms. You may not copy, resell, reverse-engineer, or build a competing service from it, or scrape or bulk-extract our data.
Do not use Bidographer to break the law, infringe others' rights, submit false or fraudulent information to any agency, upload malware, attempt to gain unauthorized access, or interfere with the service. You are responsible for complying with all rules that apply to your bids, including the requirements of each solicitation and any registration, licensing, or eligibility rules.
Bidographer relies on third-party providers (for example, payment processing, email delivery, hosting, and AI model providers). Your use of the service may be subject to their terms, and we are not responsible for their acts or omissions.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any output will be accurate or complete.
To the fullest extent permitted by law, Up Your Bids LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost contracts, or lost data, arising out of or relating to your use of Bidographer. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the three months before the claim.
You agree to defend and indemnify Up Your Bids LLC from claims, losses, and expenses (including reasonable legal fees) arising from your use of the service, your content, your bids, or your violation of these Terms or of any law.
You may stop using Bidographer at any time. We may suspend or end your access if you violate these Terms or if we need to for legal, security, or operational reasons. Provisions that by their nature should survive (ownership, disclaimers, limitation of liability, indemnification, governing law) will survive termination.
We may update these Terms from time to time. When we do, we will change the "last updated" date above, and material changes take effect when posted. Your continued use of Bidographer after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Charleston County, South Carolina, and you consent to that jurisdiction.
